Introduction

Indonesia launched the Investor KITAS as an incentive for foreign business owners and investors in 2019. The Investor KITAS is a stay permit that allows investors to live and manage their businesses in Indonesia. There are two different types of Investor KITAS, namely the C313 and C314. The only difference between these two is that C313 is valid for one year, whereas C314 is valid for two years. Both types are extendable for up to five years.

Who is eligible for the Investor KITAS?

Foreign business owners or investors are technically eligible to get the Investor KITAS if they start a business in Indonesia and satisfy the following requirements:

  1. A foreign shareholder of a PT PMA with a minimum investment of IDR 10 billion or equivalent in shares, or

  2. A foreign shareholder who holds a director or commissioner position in a PT PMA with a minimum investment of IDR 1 billion or equivalent in shares,

  3. For newly incorporated companies, you can only apply for one upon receiving the business identification number (Nomor Induk Berusaha or NIB) and the business license (Izin Usaha)

What distinguishes it from the Work Permit KITAS?

The most significant difference between the Investor KITAS (C313 and C314) and the Work Permit KITAS (C312) is that Investor KITAS holders do not need to apply for a work permit as they are not considered employees and therefore are not required to pay for the DKPTKA (Development Funds in Exchange of Hiring a Foreign Worker).

Another difference between the two is that the Work Permit KITAS is only valid for one year, whereas the other one is you can get either a one-year or a two-year, depending on the validity of your passport.

Can you work using the Investor one?

Yes, the holders who hold a director position are allowed to work for as long as the Investor KITAS is still valid. However, the holders who hold a commissioner position are not allowed to work unless they own at least IDR 10 billion in shares. Only then are they allowed to work.
